TERMS OF ENGAGEMENT

1. Introduction

Welcome to UNDER HIS WINGS PSALM 91 4 LLC, doing business as Home Man Cave (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website located at homemancave.com (the “Website”) and any related services, content, features, or products offered through the Website (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

3. Accounts and Registration

All products are subject to availability. We may limit quantities, discontinue products, or change product offerings at any time. Product images are for illustrative purposes and may vary from the actual product.

4.2 Pricing

Prices are shown in U.S. dollars unless otherwise stated and may change without notice. Taxes (if applicable) and shipping fees, if any, are displayed at checkout before you submit your order.

4.3 Payment Terms

We accept the payment methods displayed at checkout. Payments are processed securely through Shopify and/or Shopify-approved payment processors. You agree to provide current, complete, and accurate payment and billing information and authorize us (and our payment processor) to charge your payment method for your order total.

4.4 Order Acceptance and Cancellation

Your order is an offer to purchase. We may accept or decline orders in our discretion, including due to inventory limitations, errors in product or pricing information, shipping restrictions, or suspected fraud.

If you need to cancel or request changes, contact us as soon as possible. Requests must be received by 2:00 PM Pacific Time (PT) on a business day to be considered for same-day processing. Requests received after the cutoff time, or after an order has entered processing or shipped, may not be possible. Once shipped, orders cannot be canceled and are subject to our return policy.

5. Shipping and Delivery

5.1 Shipping Policy

Shipping details, delivery estimates, and any shipping fees are provided in our Shipping Policy and/or at checkout. Please review our Shipping Policy before placing an order.

5.2 Risk of Loss

Unless otherwise required by applicable law, risk of loss and title pass to you upon our delivery of the product to the carrier. Delivery dates are estimates and not guarantees.

5.3 Shipping Region

At this time, we sell and ship to addresses within the United States only, unless the Website explicitly states otherwise.

6. Returns and Refunds

Returns, exchanges, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. Please read it carefully before placing an order.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally by emailing support@homemancave.com.

15.2 Arbitration; Class Action Waiver

To the extent permitted by applicable law, any dispute that cannot be resolved informally may be resolved through binding arbitration administered by the American Arbitration Association under its applicable rules. Arbitration will occur in Oregon, United States, unless the parties agree otherwise. You and the Company agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action.

15.3 Exceptions

Either party may bring an eligible claim in small claims court, or seek injunctive or equitable relief to protect intellectual property rights.

16. Changes to Terms

We may modify these Terms at any time by posting an updated version on the Website. Changes are effective upon posting unless otherwise stated. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.

17. Miscellaneous

17.1 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

17.2 Entire Agreement

These Terms, together with our posted policies, constitute the entire agreement between you and the Company regarding the Services.

17.3 Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
